Licensing
Elvis Kennedy wants the images seen at elviskennedy.com to be seen and enjoyed by people around the world, for years to come. In a way, Elvis Kennedy can live forever through photography. If an Elvis Kennedy photograph can inspire or touch someone, or just bring a smile to a person's face - Elvis is happy. Balancing this broad view with licensing fees for commercial use and the costs of actually creating and sharing these images is a goal of Elvis Kennedy.
With that goal in mind, Elvis Kennedy allows the use of images in two forms; 1) Free, non-commercial use via the Creative Commons license, and 2) commercial uses via a licensing agreement and fee.
Free, Non-Commercial Use Under Creative Commons
You can share, copy, distribute, link to and transmit the image(s). However, you must give attribution (credit) to Elvis Kennedy and www.elviskennedy.com along with and alongside the image(s) you use. AND, the image cannot be used for any commercial use under any circumstance whatsoever. Acceptable Use Under Creative Commons - Examples;
- You have a personal website and you want to use an Elvis Kennedy image in a posting about something that an Elvis Kennedy photograph would provide an illustration of, or would be inspirational.
- Educational purposes.
- Background images on your personal computer, smart phone, iPad, etc.
- You are writing an article about some specific aspect of photography that an Elvis Kennedy image is a perfect example of.
License to Copyright
‘Commercial Use’ regarding the use of images online or offline is defined very broadly. The determination of commercial or non-commercial use is based on the contextual use of the image. The determination is NOT based on the tax-filing status of the entity using the image nor on whether or not a financial transaction takes place.
Commercial use of Elvis Kennedy images is allowed only if expressly granted by Elvis Kennedy. All commercial uses will incur a licensing fee. Fees are based on the following criteria:
- Media – print, web, television, etc.
- Distribution Size – number of copies printed, viewing audience size, exposure (regional, national, international)
- Length of Use – 1 year, 2 years, etc.
- Prominence of Display – 1/4 page, 1/2 page, full page, spread, front cover, back cover, home page (online), interior page (online), etc.

Use Requiring a License to Copyright - Examples:
- A marketing campaign for a business or commercial entity
- A fund-raising campaign for a not-for profit organization
- A background image for a website about travel
- License to create an individual print for use in a private home
